17. Malfunctions And Errors
17.1. For the purposes of these Terms, the word “malfunction” means:
any technical, operational, communication, electronic or programming error, defect, flaw or failure, whether or not same is immediately detectable to Firstbet and/or the Customer, occurring on the Website or in any –
(i) device, hardware or equipment owned or utilised by the Customer for the purposes of betting, or
(ii) betting system and/or game software, programme, data file or any other content derived therefrom operated and/or made available by the bookmaker, whether operated in the retail environment or whether downloaded and/or otherwise accessed and/or utlised by the Customer for the purposes of betting, which –
(a) causes any game or product on which betting is offered by Firstbet to be offered or betting to be accepted in such circumstances or in such a manner as to contravene these Terms and Conditions;
(b) causes any game or product on which betting is offered by Firstbet to operate otherwise than in accordance with the rules approved and/or published on the Website in respect of such game or product;
(c) corrupts, suspends or interrupts the normal and/or intended manner of operation of any game or product on which betting is offered, or
(d) results in an outcome which is manifestly out of alignment with the normal and/or intended manner of operation of any game or product on which betting is offered.
17.2. Firstbet takes all possible steps to prevent malfunctions, as well as errors, in relation to betting transactions. Errors may arise for various reasons, which may include human error on the part of the staff of Firstbet, which may result in, inter alia, late bets, the failure to accept or to reject bets, the acceptance of bets at the incorrect odds or in excess of the applicable payout limits and/or the failure to close off events on which betting is offered timeously. In all these cases, Firstbet shall be entitled to correct these errors or to void the relevant betting transactions, as further set forth in Clause 18. Firstbet is under no obligation to communicate with the customer, either before or after the affected event, with regard to any correction or voiding of a bet and the failure by the customer to receive any communication shall not entitle the customer to claim that a valid and binding betting transaction had been concluded.
17.3. Firstbet reserves the right to correct any errors in odds offered by Firstbet at any time by substituting the corrected odds as determined by Firstbet, in its sole discretion in respect of the event concerned, for the original Firstbet price, in which event the bet will be deemed to have been offered and where applicable, accepted and struck at the corrected odds.
17.4. Firstbet reserves the right to correct any errors in sports betting handicaps offered by Firstbet at any time by substituting the corrected sports betting handicaps as determined by Firstbet, in its sole discretion in respect of the event concerned, in which event the bet will be deemed to have been offered and where applicable, accepted and struck at the corrected sports betting handicaps.
17.5. If a Customer should establish or suspect, on reasonable grounds, that Firstbet’s computer system and/or its employees or agents may have made an error in offering or accepting a betting transaction, then the customer is urged (and required by the common law) to communicate with Firstbet to determine whether in fact an error has occurred, in order to avoid any potential dispute and/or disappointment resulting from the correction of the error or voiding of the transaction in question.
17.6. Firstbet reserves the right to correct results where they have been previously incorrectly processed and paid. Firstbet accounts which have been incorrectly credited with incorrect winnings as a result will be adjusted to reflect the corrected position or where customers are erroneously paid incorrect winnings in cash, electronically or in any other manner, then the incorrect winnings will be deducted from the Customers’ Firstbet account, and account holders hereby authorise Firstbet to deduct any such amount and also waive all and any claim which they may have against Firstbet for payment of any amount incorrectly credited to their accounts or incorrectly paid to them in cash.
17.7. Any error in venue, time, date, team composition, identity of any competitor in respect of any event on which betting is offered by Firstbet shall not entitle the customer to a refund of stakes or to avoid the bet concerned.
